Blotter: “Blindfolded” bingo in ‘Bama

An Alabama state police officer reported that the electronic bingo machines at the Country Crossing gaming facility in Dothan do not qualify as a bingo game under state law since they do not require the players to interact with the machine when marking their numbers.

Lieutenant Mike Reese of the Alabama Alcoholic Beverage Control Board stated that, since the players did not need to mark their cards or recognized a winning combination, the players could play the machines blindfolded and still win.

In his affidavit to U.S. District Judge Myron Thompson, Lieutenant Reese, also a member of Governor Bob Riley's Task Force on Illegal Gambling, said that the player only had to press a button three times and did not even have to look at their electronic bingo "card" to determine if they won a prize. The task force filed a search warrant to raid Country Crossing and seize more than a thousand bingo machines at the facility, but a local judge overturned the warrant for lack of evidence.

Ronnie Gilley, the developer of Country Crossing, has stated that the machines meet the standards set by the state law and that the attempted raids were politically motivated. He also said that the facility, which houses restaurants, a hotel and an entertainment complex, has generated over a thousand jobs in an area where unemployment has skyrocketed since the recession began in the fall of 2008. Mr. Gilley has asked Judge Thompson not to allow the task force to pursue another raid on the facility, which has been closed for nearly a week due to its uncertain legal status.

Another electronic bingo hall has fallen under the scrutiny of the state's anti-gambling task force. Attorneys for VictoryLand in rural Macon County have asked the state supreme court to maintain a restraining order against the task force currently in place preventing them from seizing more than six thousand bingo machines.
